Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Roamadi mobile application and related services (collectively, the "Service"), operated by Doaa Othman (Independent Developer) based in the Netherlands ("Roamadi", "we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this age requirement and have the legal capacity to enter into these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. Your Account

You can browse Roamadi (cities, places, videos, communities) anonymously. Generating AI itineraries, saving trips, casting votes, and syncing content across devices require an account. Authentication is provided by Clerk using your Apple ID or Google account; we do not store passwords ourselves.

You are responsible for safeguarding access to your authentication provider account and for any activity that occurs under your Roamadi account. We are not liable for losses caused by unauthorized access to your Apple ID or Google account.

3. Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose or in violation of local, national, or international law.
• Scrape, mine, or otherwise extract data from the Service in bulk without our written permission.
• Attempt to gain unauthorized access to any part of the Service, other users' accounts, or our infrastructure.
• Reverse engineer, decompile, or disassemble any part of the Service, except to the extent such restriction is prohibited by applicable law.
• Submit prompts or content that is unlawful, defamatory, harassing, threatening, hateful, discriminatory, or that infringes the rights of others.
• Use the Service to generate content for illegal commercial purposes or to defraud others.
• Submit content designed to manipulate AI outputs (prompt injection) against the interests of other users or Roamadi.
• Interfere with the operation of the Service, including distributing malware, overloading our infrastructure, or circumventing rate limits.

4. AI-Generated Content

A core feature of Roamadi is using artificial intelligence (currently Anthropic's Claude model) to bring the best out of AI for travel planning — curating day-by-day itineraries tailored to your taste, the length of your trip, your group, your interests, and the destination you've chosen. The aim is to save you hours of research and help you organize your trip around what you actually want to do.

Specifically:

• AI suggestions are not professional travel, legal, medical, or financial advice.
• Place data (locations, ratings, hours, photos) comes from third parties such as Google Maps Platform and may be inaccurate or stale. Hours change without notice.
• We do not warrant that any place, restaurant, attraction, or activity recommended by the AI is safe, lawful in your jurisdiction, available at the times suggested, or appropriate for your group.
• You are solely responsible for decisions you make based on AI-generated suggestions. Roamadi disclaims liability for any inaccuracies in AI output to the maximum extent permitted by applicable law.

5. Third-Party Content

A central goal of Roamadi is to give you a clear, honest picture of each destination before you visit. To do that, we surface the most relevant third-party content we can find — real photos, real ratings, real short-form videos showing what places actually look like — so you can make informed travel decisions instead of relying on stock imagery or marketing copy.

Specifically, Roamadi displays content from third-party sources, including but not limited to:

• Place information, photos, and ratings from Google Maps Platform.
• Short-form travel videos showing destinations and venues. These are sourced from public social platforms (including YouTube and TikTok) and curated by our team for relevance to the destination.
• External links to maps, social media, and provider websites.

We do not own, control, or endorse third-party content. We are not responsible for the accuracy, completeness, legality, or safety of content sourced from third parties. Your interactions with third-party services are governed by their respective terms and privacy policies, not ours.

6. Your Content

The itineraries you generate, the trips you create, the votes you cast, and the free-text prompts you submit are collectively "Your Content". You retain ownership of Your Content.

By submitting Your Content to the Service, you grant Roamadi a worldwide, non-exclusive, royalty-free license to host, store, process, and display Your Content for the purpose of providing the Service to you and (where applicable) to other users you share it with (e.g., collaborative trip members). This license terminates when you delete Your Content or your account, except where retention is required by law.

You represent that you have all necessary rights to Your Content and that submitting it doesn't infringe any third party's rights.

7. Intellectual Property

The Roamadi name, logo, app design, code, algorithms, curated content, and all other elements of the Service (excluding Your Content and third-party content) are the property of Roamadi or its licensors, protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

8. Service Availability and Changes

We strive to keep the Service available 24/7 but do not guarantee uninterrupted availability. We may suspend, modify, or discontinue any part of the Service at any time without prior notice, including features, content sources, AI models, or supported destinations.

Free-tier limits (currently 3 AI-generated itineraries per calendar month) may be adjusted at any time as we tune costs and capacity.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF AI OUTPUT.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ROAMADI DISCLAIMS ANY WARRANTY THAT (a) THE SERVICE WILL MEET YOUR REQUIREMENTS, (b) THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, (c) AI-GENERATED CONTENT WILL BE ACCURATE OR APPROPRIATE FOR YOUR CIRCUMSTANCES, OR (d) ANY ERRORS WILL BE CORRECTED.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ROAMADI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, LOSS OF DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY.

ROAMADI'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID ROAMADI IN THE PRECEDING TWELVE (12) MONTHS, OR (b) ONE HUNDRED DOLLARS (US$100).

Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability, so the limitations above may not apply to you. Where required by law, our liability is limited to the maximum extent permitted by your local law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Roamadi from any claim, demand, loss, or damages, including reasonable attorneys' fees, arising out of or related to (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any third party's rights, or (d) Your Content.

12. Termination

You may stop using the Service at any time. You may also permanently delete your account from inside the app (Profile → Delete account). Account deletion is processed immediately: your profile, trips you created, votes you cast, and trip memberships are removed from our active database the moment you confirm. Any itineraries you generated have your user ID stripped at the same time and remain only in fully anonymized form. Residual traces in disaster-recovery backups and error logs are automatically purged within 30 days. See Section 4 of our Privacy Policy for details.

We may suspend or terminate your access to the Service immediately, without prior notice, if you violate these Terms or engage in conduct that we reasonably believe is harmful to other users, third parties, or Roamadi.

Upon termination, sections that by their nature should survive (e.g., intellectual property, disclaimers, limitation of liability, indemnification) will survive.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, sending a notice in the app. Continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the Netherlands, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the competent courts of Almere, the Netherlands, and you consent to the personal jurisdiction of those courts.

If you reside in the European Union, nothing in this Section limits any mandatory consumer-protection rights you have under the laws of your country of residence. Nothing in this section prevents either party from seeking injunctive relief in any court of competent jurisdiction.

15. Miscellaneous

• Entire agreement — these Terms and our Privacy Policy constitute the entire agreement between you and Roamadi regarding the Service.
• Severability — if any provision is held unenforceable, the remaining provisions remain in effect.
• No waiver — our failure to enforce any provision is not a waiver of our right to do so later.
• Assignment — you may not assign these Terms; we may assign them to a successor in connection with a merger, acquisition, or sale of assets.

16. Apple App Store Additional Terms

If you downloaded the Service from the Apple App Store, you acknowledge and agree to the following:

• Acknowledgement. These Terms are concluded between you and Roamadi only, and not with Apple Inc. ("Apple"). Roamadi, not Apple, is solely responsible for the Service and its content.
• Scope of License. The license granted to you for the Service is limited to a non-transferable license to use the Service on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple App Store Terms of Service.
• Maintenance and Support. Roamadi is solely responsible for providing any maintenance and support services for the Service, as specified in these Terms or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Service.
• Warranty. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Service to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Service, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Roamadi's sole responsibility.
• Product Claims. You acknowledge that Roamadi, not Apple, is responsible for addressing any claims by you or any third party relating to the Service or your possession and/or use of it, including (i) product-liability claims, (ii) any claim that the Service fails to conform to any applicable legal or regulatory requirement, and (iii) claims arising under consumer-protection, privacy, or similar legislation.
• Intellectual Property. In the event of any third-party claim that the Service or your possession and use of the Service infringes that third party's intellectual property rights, Roamadi (not Apple) will be solely responsible for the investigation, defense, settlement and discharge of any such claim.
• Compliance with Laws. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
• Third-Party Beneficiary. You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
